Digital security is one of the main current concerns, governments are overwhelmed, which is why the European Union has decided to take a step forward. Thus, the European Parliament establishes the obligations provided for in the second paragraph of the’article 22 of Law 34/2002, of July 11, on information society services and electronic commerce, with a view to regulating more firmly the General Data Protection Law and guarantee the digital rights of users. In this way, it seeks further increase user security when using their data which are collected online through different channels.
The resolution is really complex. You may be thinking: how does it affect me? If you have a website (of any kind) open to the public, you should consider:
- You must allow the user to manage each type of cookie separately. (necessary, not necessary and analysis), that the user can accept, deny or customize the consent as they see fit. Continuing to browse is no longer a valid way to give consent. Previously, it was simply mandatory to give the option to accept (and you could access the website) or reject (your access was blocked).
- Obligation of transparency: inform and provide the definition and generic function, the types of cookies used and their purpose, identifying who they are used for, whether there are data transfers to third countries, profiles and automated decisions, the periods of conservation of the information of each cookie and the rights of interest groups. That is why you now see sheets of texts and options on the screen on each website you access.
- The information must be displayed in a way: concise, transparent, intelligible, with clear language and that is easily accessible. It is mandatory to follow a series of legal guidelines when drafting them and choosing what content they should provide, the support of a legal entity is a very good recommendation.
- Website data management: there is a series of cookie data that you do not have control over because they are for the operation of the website, and, therefore, are necessary. It is very important that they follow a series of security guidelines and protocols that must be part of your site on the network.
In other words, not complying with any of these points implies violating the law, something like committing a crime, which will lead to sanctions.
